new build home built on contaminated land?

if a new house builder has built a house in the u.k on contaminated land causing a long delay on entry to the house ,and then has in papers to the local authority admitted that they built on contaminated land and were fully responsible ...would i be able to claim compensation?

  2. You would need to have proof positive and with the help of good laywer you ought to be able to claim compensation from both the builder and the council. The builder would have known it was a contaminated site as he would be required to take core soil samples of the building land prior to obtaining planning permission..

  4. Legally studies (desk studies...soil samples, water samples etc) should have been carried out on the land before development started. When it was found to be contaminated by law it is up to the people who contaminated it in the first place if it was that kind of contamination. However if the contamination was like organic it was up to the housing developers to treat the land before building commenced. I really don't understand how they achieved planning permission!! They are 100% responsible therefor your claim for compo should be met by them. If you have any trouble get a good lawyer who knows the facts on building on brownfield(previously developed land) which is more than likely what the house was built on. Hope this helps.
